Most of us in the sec world already know that NO transfers are safe that are unencrypted. In the case of governments, I'm not so sure about most encrypted transfers either.
Anyway, you might consider that in addition to ISPs, there are also many routers that all transfers travel thru. At any point along the route, it can be intercepted. At the routers and servers, these transfers are technically held in storage for a period.
The case discussed in the linked article here has just basically made it(at least temporarily) legal for the companies that provide services to monitor these transfers including email.
